Terms of Use

This End-User License Agreement ("Agreement" or "Terms") is a legal agreement between you ("you", "the user") and Habitics s.r.o. ("Habitics", "we", "us", the "Owner") governing your use of the Sleep Sounds mobile application and all of its content and features (the "Software" or "App"). By installing or using the Software, you agree to be bound by these Terms. If you do not agree, do not install or use the App.

1. License

Subject to your compliance with these Terms, Habitics grants you a non-exclusive, non-transferable, non-sublicensable, revocable, limited right and license to install and use one copy of the Software on a device you own or control, solely for your personal, non-commercial use. The Software is licensed, not sold. All rights not expressly granted to you are reserved by Habitics.

2. Restrictions of Use

You agree that you will not, and will not permit others to:

• copy, modify, adapt, translate, or create derivative works of the Software;
• reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software, except to the extent expressly permitted by applicable law;
• extract, separate, rip, redistribute, sell, license, rent, or otherwise exploit the audio recordings, images, or other content bundled with the App;
• remove, obscure, or alter any copyright, trademark, or other proprietary notices;
• use the Software for any unlawful purpose or in any way that could damage, disable, or impair it.

3. Intellectual Property

The Software and all of its content — including the sound recordings, background scenes and images, icons, user interface, design, text, and the "Sleep Sounds" name and logo — are owned by Habitics or its licensors and are protected by copyright, trademark, and other intellectual-property laws. Title to the Software remains with Habitics at all times; nothing in these Terms transfers any ownership to you. Attribution for third-party audio and open-source components, where applicable, is provided within the App.

4. Privacy

Your use of the Software is also governed by our Privacy Policy, which explains what limited, anonymized data the App processes. The App contains no advertising, no user accounts, and no in-app purchases.

5. Medical Disclaimer

Sleep Sounds provides ambient and relaxing audio intended for general relaxation, rest, and wellbeing. The Software is not a medical device and is not intended to be a substitute for professional medical advice, diagnosis, or treatment. It does not diagnose, treat, cure, or prevent insomnia or any other health condition. If you have concerns about your sleep or health, consult a qualified healthcare professional. Do not use the App while driving or operating machinery, or in any other situation where listening to audio or falling asleep could be unsafe.

6. Disclaimer of Warranty

The Software is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, whether express, implied, or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Habitics does not warrant that the Software will be uninterrupted, error-free, or free of harmful components, or that it will meet your requirements.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Habitics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising out of or in connection with your use of (or inability to use) the Software. Because the App is provided free of charge, to the extent any liability cannot be excluded, it shall be limited to the greatest extent permitted by law.

8. Indemnity

You agree to indemnify and hold harmless Habitics and its directors, employees, and affiliates from and against any claims, damages, losses, liabilities, and expenses arising out of your misuse of the Software or your violation of these Terms.

9. Updates and Modifications

Habitics may, from time to time, release updates, modifications, or improvements to the Software, and may add or remove features at its discretion. These Terms apply to any updated version of the Software you install.

10. Termination

This Agreement remains in effect until terminated. Your rights under this Agreement will terminate automatically if you fail to comply with any of its terms. Upon termination, you must stop using the Software and uninstall it. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnity) will survive.

11. App Store Terms

The Software is distributed through the Google Play Store, and your use is also subject to the applicable Google Play Terms of Service. Any issues relating to downloading or installing the App via the store are governed by that store's policies.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Slovak Republic, without regard to its conflict-of-law provisions. The courts competent for the registered seat of Habitics s.r.o. shall have jurisdiction over any dispute arising from these Terms, subject to any mandatory consumer-protection rights you may have in your country of residence.

13. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the "Last updated" date above. Your continued use of the Software after changes take effect constitutes your acceptance of the revised Terms.
